Los Morales Polanco C.P. 11510, in compliance with the provisions of the Federal Law on Protection of Personal Data in Possession of Private Parties and its Regulations, in order to guarantee privacy and the legitimate and informed treatment of your Personal Data,  makes available to you the following Privacy Notice: <\/p>\n<p style=\"font-size: 30px; color: #00607b; font-weight: bold; margin: 0;\">1. Consent of the Owner<\/p>\n<p>For the purposes of the provisions of the Federal Law on the Protection of Personal Data in Possession of Private Parties (the LFPDP) and other applicable legislation, the Owner declares (i) that this Notice has been made known to him by the Responsible Party, (ii) has read, understood and agreed to the terms set forth in this Notice, for which he grants his consent with respect to the processing of his personal data,  acts will be carried out that constitute the express consent of the Owner and (iii) that he grants his consent for <b>IT ERA<\/b> or its Processors to carry out transfers and\/or remittances of personal data in terms of the section called &#8220;Transfers&#8221; of this Notice.   <\/p>\n<p style=\"font-size: 30px; color: #00607b; font-weight: bold; margin: 0;\">2. Purposes<\/p>\n<p>The Processing of Personal Data has the primary purpose of:<\/p>\n<ul class=\"list_default\" style=\"padding-left: 50px !important; list-style: upper-alpha;\">\n<li>Provide the required services and products<\/li>\n<li>To inform about new products or services that are related to what has been contracted or acquired by the Client<\/li>\n<li>Comply with the obligations contracted with our clients<\/li>\n<li>To inform about changes to our products or services, evaluate the quality of service, and advertising in general, offered by or related to <b>IT ERA.<\/b><\/li>\n<\/ul>\n<p style=\"font-size: 30px; color: #00607b; font-weight: bold; margin: 0;\">3. Personal data collected<\/p>\n<p>The term &#8220;Personal Data&#8221; in this Notice refers to all personal information that can be used to identify you, which will be the following:<\/p>\n<ul class=\"list_default\" style=\"padding-left: 50px !important; list-style: disc;\">\n<li>Full name<\/li>\n<li>Age<\/li>\n<li>Date of birth<\/li>\n<li>Domicile<\/li>\n<li>Nationality<\/li>\n<li>Email<\/li>\n<li>Home, office or work phone, cell phone<\/li>\n<li>Company where he works<\/li>\n<\/ul>\n<p><b>IT ERA<\/b> informs you that, in the event of collecting financial and patrimonial data, such as Credit Card Data, they do not require express consent to be used. The foregoing, in accordance with Articles 8, 10 and 37 of the Law. <\/p>\n<p style=\"font-size: 30px; color: #00607b; font-weight: bold; margin: 0;\">4. Transfers<\/p>\n<p><b>IT ERA<\/b> may transfer your Personal Data to third parties commercially or contractually related to <b>IT ERA<\/b>, as long as it is necessary to comply with the purposes described in this privacy notice. <b>IT ERA<\/b> may also transfer your Personal Data in the specific cases provided for by law.<\/p>\n<p>Therefore, <b>IT ERA<\/b> may transfer your Personal Data to the following entities:<\/p>\n<ul class=\"list_default\" style=\"padding-left: 50px !important; list-style: decimal;\">\n<li><b>IT ERA&#8217;s<\/b> national and international affiliated companies and subsidiaries.<\/li>\n<li>Third-party service providers for compliance with the legal obligations acquired by <b>IT ERA.<\/b><\/li>\n<li>Commercial partners with whom <b>IT ERA<\/b> carries out agreements or contracts focused on the development of new products and\/or services.<\/li>\n<li>Third parties requesting employment references from former <b>IT ERA<\/b> employees.<\/li>\n<li>Third parties arising from a corporate restructuring, including merger, consolidation, sale, liquidation or transfer of assets.<\/li>\n<li>Other transfers provided for in the aforementioned Law and its Regulations.<\/li>\n<\/ul>\n<p>Third parties and entities receiving Personal Data assume the same obligations and\/or responsibilities as <b>IT ERA<\/b>, in accordance with what is described in this Privacy Notice. <b>IT ERA<\/b> will ensure that such third parties maintain adequate administrative, technical and physical security measures to safeguard your Personal Data, as well as that said third parties use your Personal Data solely and exclusively for the purposes for which they were contracted and in accordance with this Privacy Notice and the Law.<\/p>\n<p style=\"font-size: 30px; color: #00607b; font-weight: bold; margin: 0;\">5. ARCO Rights<\/p>\n<p><b>IT ERA<\/b> informs the Owner of the Personal Data that he\/she may exercise at any time the Rights of Access, Rectification, Cancellation and\/or Opposition (ARCO) to the processing of his\/her Personal Data, as well as revoke his\/her consent, through the submission of a written request at the address of <b>IT ERA<\/b>, or through the email:  <a href=\"mailto:privacidad@iteraprocess.com\">privacidad@iteraprocess.com<\/a><\/p>\n<p>To facilitate access to ARCO rights, they are described below:<\/p>\n<ul class=\"list_default\" style=\"padding-left: 50px !important; list-style: decimal;\">\n<li>Access: you may request to be informed what type of Personal Data is being processed by <b>IT ERA.<\/b><\/li>\n<li>Rectification: You may request that incorrect or incomplete Personal Data in the possession of <b>IT ERA<\/b> be corrected or completed. You, as the Owner of your Personal Data, will have the responsibility to inform <b>IT ERA<\/b> when a change or correction needs to be made to your Personal Data. <\/li>\n<li>Cancellation: You may request that Personal Data be cancelled, you may do so personally or through your duly accredited legal representative. There are cases in which Personal Data cannot be cancelled by law. <\/li>\n<li>Opposition: you can oppose the use you are giving to your Personal Data, you can do it personally or through your legal representative, duly accredited.<\/li>\n<\/ul>\n<p>The application to exercise your ARCO rights must contain the following information:<\/p>\n<ul class=\"list_default\" style=\"padding-left: 50px !important; list-style: decimal;\">\n<li>The full name of the Personal Data Subject.<\/li>\n<li>The address and other means of communicating the response to your request;<\/li>\n<li>Valid documents proving their identity (simple copy in printed or electronic format of their voter card, passport or Visa) or, where applicable, the legal representation of the Holder (simple copy in printed or electronic format of the simple power of attorney with the handwritten signature of the Holder, the representative and their corresponding valid official identifications \u2013 voter&#8217;s card,  passport or visa);<\/li>\n<li>A clear and precise description of the data in respect of which you seek to exercise any of the ARCO Rights, and<\/li>\n<li>Any other element or document that facilitates the location of Personal Data.<\/li>\n<\/ul>\n<p>In the case of requests for rectification of personal data, the Owner must also indicate the modifications to be made and provide the documentation that supports their request.<\/p>\n<p>In order to comply with the obligation of access to your personal data, the identity of the Owner or the personality of the representative will be previously accredited; making the information available on site at the Responsible Party&#8217;s home. Another means may be agreed between the Owner and the Responsible Party provided that the information requested allows it. <\/p>\n<p>To exercise any of the ARCO rights, as well as to request the applicable forms, the Owner may send the respective request to the e-mail address <a href=\"mailto:privacidad@iteraprocess.com\">privacidad@iteraprocess.com<\/a>, or in writing to the following address: Jos\u00e9 Luis Lagrange No. 103, Piso 3-A1, Colonia los Morales Polanco, Delegaci\u00f3n Miguel Hidalgo C.P. 11510. The Owner shall describe the Personal Data to which he refers and the Right he seeks to exercise. <\/p>\n<p>In the event that the information provided in your application is erroneous or insufficient, or if the corresponding accreditation documents are not attached, we may ask you, within five working days of receiving the application, to provide the elements or documents necessary to process it. The Owner will have ten working days to respond to the requirement, counted from the day after receiving it. <\/p>\n<p>If no response is given within this period, the corresponding application will be deemed not to have been submitted.<\/p>\n<p><b>IT ERA<\/b> will respond to the Owner within a maximum period of twenty business days, counted from the date on which the request was received, so that, if appropriate, it may be made effective within fifteen business days following the response is communicated. In all cases, the response will be given by the same means by which you have submitted your application or, where appropriate, by any other means agreed with the Owner. The aforementioned deadlines may be extended in terms of the LFPDP.  <\/p>\n<p style=\"font-size: 30px; color: #00607b; font-weight: bold; margin: 0;\">6. Limitation of Use and Disclosure of Information<\/p>\n<p>The Controller and\/or its Processors will keep the Owner&#8217;s personal data for as long as necessary to process their requests for information, products and\/or services, as well as to maintain accounting, financial and audit records in terms of the LFPDP and current commercial, tax and administrative legislation.<\/p>\n<p>The personal data collected will be protected by adequate administrative, technical and physical security measures against damage, loss, alteration, destruction or unauthorized use, access or treatment, in accordance with the provisions of the LFPDP and other applicable legislation. Notwithstanding the above, <b>IT ERA<\/b> does not guarantee that unauthorized third parties will not be able to access the physical or logical systems of the Data Controllers or the Data Controller or the electronic documents and files stored in their systems. Consequently, <b>IT ERA<\/b> will not be liable under any circumstances for any damages that may arise from such unauthorised access.  <\/p>\n<p>You may also limit the use or disclosure of your Personal Data in accordance with the following:<\/p>\n<ul class=\"list_default\" style=\"padding-left: 50px !important; list-style: disc;\">\n<li>Register in the Public Registry to avoid Advertising by the Federal Consumer Protection Agency. For more information regarding this option, you can contact PROFECO directly by entering the following link: <a href=\"http:\/\/rpc.profeco.gob.mx\">http:\/\/rpc.profeco.gob.mx<\/a> or by calling from Mexico, Guadalajara and Monterrey at 96 28 00 00 and from the rest of the Mexican Republic at 01 800 962 8000. <\/li>\n<li>You can also register at the following link, in the section: &#8220;consumers \u2013 register your phone number&#8221; by entering the requested data.<\/li>\n<li>Request <b>IT ERA<\/b> to register you on the &#8220;Exclusion List&#8221;, in order not to receive information about our products and services.<\/li>\n<\/ul>\n<p style=\"font-size: 30px; color: #00607b; font-weight: bold; margin: 0;\">7. Modifications to the Privacy Notice<\/p>\n<p><b>IT ERA<\/b> reserves the right to modify this Privacy Notice as it deems appropriate.
